Truancy Petition Court Process
- Filing a Truancy Petition with an Order to Stay Proceedings requires the following forms:

- On the Truancy Petition be sure to fill in all fields, including check box under 3.1 To Stay Proceedings
- The clerk will issue a cause number and submit the petition and order to the judge for review.
- The clerk will then return a copy of the petition and order to the school.
- School shall either pick up the documents at the front desk, M-F, 8 am - 5 pm or request to be returned by mail, (Please notify clerk which option).
- It is then the school’s responsibility to serve the student and parent.
- The Return of Service or Acceptance of Service must be filed with the clerk.
- a. If the school wants to Lift the Stay, the following forms are required:

- Re-submit copy of original petition with corrections and supporting documentation Write “AMENDED” on initial petition above the Case # that was filed, then add any additional steps that were taken since filing of the original petition in sections 1.4, 2.3 and under 3.1 uncheck Stay Proceeding and check set a date and time and file with the clerk.
- The clerk will then return a copy of the petition and order to the school.
- School shall either pick up the documents at the front desk, M-F, 8 am – 5 pm or request to be returned by mail, (Please notify clerk which option).
- It is then the school’s responsibility to serve the student and parent.
- The Return of Service or Acceptance of Service must be filed with the clerk
- A school representative is required to appear in person on the date of the hearing with the following order:
Findings and Order on Truancy Petition, body of the order is completed after the court’s ruling but the heading can be filled in prior to court
- Filing a Truancy Petition with a request for immediate court action requires the following forms:

- School shall either pick up the documents at the front desk, M-F, 8 am – 5 pm or request to be returned by mail, (Please notify clerk which option).
- It is the school’s responsibility to serve the student and parent.
- A Return of Service or Acceptance of Service must be filed with the clerk.
- A school representative is required to appear in person on the date of the hearing with the following order:
Findings and Order on Truancy Petition – body of the order is completed after the court’s ruling, but the heading can be filled in prior to court.
- Review Hearing, one the following forms are needed:

- A school representative is required to appear in person at all Review Hearings:
- The body of the review orders are completed after the court’s ruling.
- Filing a Contempt, the following forms are needed:

- The clerk will submit the motion and order to show cause on contempt for the judge to
review. - The clerk will then return a copy of the motion and order to show cause on contempt to the school.
- School shall either pick up the documents at the front desk, M-F, 8 am – 5 pm or request to be returned by mail, (Please notify clerk which option).
- It is then the school’s responsibility to serve the student and parent.
- The Return of Service or Acceptance of Service must be filed with the clerk.
- A school representative is required to appear in person on the date of the hearing with the following order:
- The clerk will submit the motion and order to show cause on contempt for the judge to
Truancy Order on Hearing – the body of the order is completed after the court’s ruling, but the heading can be filled in prior to court.
- Dismissal Hearing, the following order is required:
Dismissal Order is provided in the courtroom and submitted upon the courts request.
- If student changes school districts* after a truancy petition has been filed:
- Originating school should notify the new school district the student is transferring to that there is a pending or active petition already filed so new school district is aware of the existing case #.
- The new school district will then file a new Amended Truancy Petition write in or template using same the Case #.
- Follow instructions in Section 1 or 2 of this document depending on whether Amended Petition is being filed as a stay or a request for immediate court action and submit all orders and documentation as required.
* If a student is changing schools within the same district i.e., middle School to high School, just notify the clerk and she will make the changes accordingly.

Note: all Truancy Petitions are dismissed at the end of the school year or at age 18 whichever comes first unless student has been ordered to attend summer school then petition continues
